Mexico to appeal injunction favoring renewables companies

• APPEAL: Mexico’s electric grid operator (CENACE) said that the López Obrador administration will appeal a Mexican federal judge’s decision to grant a series of temporary injunctions against its controversial directive curbing performance tests for new solar and wind plants across the country.

 

• ADMINISTRATIVE: Saying it will abide by the judge’s orders while litigation ensues, the Mexican electric grid operator argued Tuesday that federal judge Rodrigo de la Peza lacked jurisdiction saying that the issue was not an “anti-trust” matter but rather an “administrative” issue.

 

• DANGER: “(The judge) granted the temporary injunction without identifying the impact to the (National Electric System), endangering such a public good to the detriment of the Mexican State”, CENACE said after being notified by the judge’s decision on Monday.

 

• RELIABILITY: The López Obrador administration argued that the decision to curb performance tests for new solar and wind plants -effectively stopping any further work- was an urgent measure given that wind and solar plants were not reliable energy sources during the coronavirus emergency.
