Mexican judge grants preliminary injunction to renewables firms

• TEMPORARY: A Mexican federal judge issued Monday preliminary injunctions in favor of two renewables companies stopping temporarily a controversial government directive suspending performance tests for new wind and solar power plants.

 

• COMPETITION: Experts argue that the directive issued by the Mexican government grid operator (CENACE) is an attempt to favor electricity produced by state-owned utility (CFE) using fuel oil plants. Judge Rodrigo de la Peza will decide on a temporary injunction on May 22.

 

• CRITICISM: “Medium and long-term investment projects require a minimum certainty framework to plan their investments”, said Ángel García-Lascurain, head of private sector think tank IMEF. “From the point of view of public finances this is going to mean a drop in investment”.

 

• UNCERTAINTY: Last week, Canada and the European Union (EU) made their concerns heard around the changes in the Mexican electric market. The US Ambassador to Mexico, Chris Landau, said recently that his government had expressed their own concerns about change in rules.
